1. Acceptance of Terms

By accessing or using LastSend ("Service"), owned and operated by Brand Jet Media ("Company", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

LastSend is a posthumous messaging service that allows users to create messages to be delivered to designated recipients after verification of the user's passing or prolonged inactivity. Given the sensitive nature of this Service, please read these Terms carefully.

2. Eligibility

You must be at least 18 years old to use this Service. By using LastSend, you represent that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will use the Service only for lawful purposes
• All information you provide is accurate and truthful

3. Account Responsibilities

When you create an account, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. The Check-In System

The core of our Service relies on regular check-ins to confirm your well-being. You understand and agree that:

• You must check in at your selected frequency (weekly, bi-weekly, or monthly)
• Missed check-ins will trigger reminder notifications
• Multiple missed check-ins will initiate the escalation process
• We will attempt to contact you and your trusted contacts before delivering messages
• It is your responsibility to keep your contact information current

5. Trusted Contacts

Trusted contacts are individuals you designate to verify your status during escalation. By designating trusted contacts, you confirm that:

• You have obtained their consent to be contacted by LastSend
• You have provided them accurate information about their role
• They understand they may be contacted to verify your status
• You accept that their confirmation may trigger message delivery

Trusted contacts must verify their email address before they can participate in the escalation process.

6. Message Recipients

Message recipients are individuals designated to receive your posthumous messages. By adding recipients, you confirm that:

• You have a legitimate relationship with the recipient
• The content you send is intended for their receipt
• You understand messages cannot be recalled once delivered
• Recipients may receive an introductory notification when added

7. Content Guidelines

You agree that all content you create and upload will NOT contain:

• Illegal content or content promoting illegal activities
• Threats, harassment, or content intended to harm others
• Sexually explicit or pornographic material
• Violent or graphic content
• Hate speech or discriminatory content
• Content that infringes on others' intellectual property
• Malware, viruses, or malicious code
• Spam or misleading information

We reserve the right to reject or remove content that violates these guidelines. Repeated violations may result in account termination.

8. Content Moderation

All uploaded photos and videos are automatically scanned for prohibited content. By uploading media, you consent to this automated review. Content that is flagged will be reviewed and may be rejected. Voice recordings and text messages are not automatically moderated but are subject to our content guidelines.

9. Message Delivery

Important: While we make every reasonable effort to deliver your messages as intended, we cannot guarantee:

• Messages will be delivered at any specific time
• Recipients will receive or read your messages
• Email delivery will not be blocked by spam filters
• Recipients' email addresses will remain valid
• Memorial pages will be accessible indefinitely

Message delivery is triggered only after our verification process, which includes multiple check-in reminders and trusted contact confirmation.

10. Subscription & Payments

LastSend offers free and paid subscription tiers. For paid subscriptions:

• Payments are processed through Dodo Payments (web) or Google Play Billing (Android)
• Subscriptions automatically renew unless cancelled
• You can cancel anytime through your account settings or your device's app store settings
• Downgrading to free tier does not delete existing content beyond free tier limits

Web payments are processed by Dodo Payments as the Merchant of Record. Dodo Payments handles all payment processing, tax collection, invoicing, and billing support for web subscriptions.

10a. Refund Policy

We offer a 14-day refund window from the date of your initial subscription purchase. If you are not satisfied with your paid plan, you may request a full refund within 14 days of your first payment.

• Web subscriptions (Dodo Payments): Contact us at support@brandjetmedia.com to request a refund within 14 days of purchase
• Google Play subscriptions: Refunds are handled according to Google Play's refund policies. You can request a refund through the Google Play Store within 14 days of purchase

After the 14-day refund window, subscription fees are non-refundable. You may cancel your subscription at any time to prevent future charges, and you will retain access to your paid features until the end of your current billing period.

11. Subscription Cancellation Upon Account Completion

When your LastSend account is activated and your messages are delivered to your recipients, your subscription is automatically cancelled. You will not be charged after your messages have been sent.

This ensures that your loved ones receive your messages without any ongoing financial obligation to your estate or beneficiaries.

12. Intellectual Property

Your Content: You retain ownership of all content you create. By using the Service, you grant us a limited license to store, process, and deliver your content as necessary to provide the Service.

Our Content: The LastSend name, logo, app design, and all related intellectual property belong to us. You may not use our trademarks without written permission.

13. Limitation of Liability

To the maximum extent permitted by law, LastSend and its operators shall not be liable for:

• Emotional distress caused by message delivery (intended or unintended)
• Failed or delayed message delivery
• Accidental triggering of messages due to missed check-ins
• Actions taken by trusted contacts during verification
• Loss of data due to technical failures
• Any indirect, incidental, or consequential damages

Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

15. Indemnification

You agree to indemnify and hold harmless LastSend from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

16. Account Termination

By You: You may delete your account at any time through the Settings page. Upon deletion, all your data will be permanently removed within 30 days.

By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We will attempt to provide notice before termination when possible.

17. Changes to Service

We reserve the right to modify, suspend, or discontinue the Service at any time. We will provide reasonable notice of significant changes. Continued use of the Service after changes constitutes acceptance of the modified Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
